Terms of Service — HIBR 3D

1. Agreement

These Terms govern your use of HIBR 3D (the "Service"), operated by Hibr AI ("we"). By creating an account or using the Service you accept these Terms, our Acceptable Use Policy, Privacy Policy, and DMCA Policy.

2. Eligibility & accounts

• You must be at least 18 years old, or the age of majority in your jurisdiction if that is greater. This matches Section 1.4 of the HIBR Terms & Conditions, which you accept at checkout and which governs where the two documents differ.
• You are responsible for your account credentials and all activity under your account.

3. The Service

HIBR 3D generates 3D models from text and images using our own and third-party AI models. Outputs are generated automatically and may be imperfect, inaccurate, or unsuitable for a given purpose. Outputs are not engineering-certified. You are responsible for verifying any model before manufacturing, printing, or relying on it.

4. Credits, plans, and payments

• The Service uses a credit system and subscription/one-time plans described on our Pricing page. Prices, credit costs, and allotments may change with notice.
• Payments are processed by Stripe. Subscriptions renew automatically until cancelled. Credits may expire as stated at purchase.
• Refunds are handled per our posted refund policy and applicable law.

5. Your content (inputs) and outputs

• Inputs: you retain ownership of content you upload and represent that you have the rights to use it and that it does not infringe others' rights or violate the AUP.
• Outputs: you may use what you generate on a paid plan for commercial purposes. We do not transfer ownership of an AI-generated file to you, because no party in the chain grants it: our model providers license us to run their models, grant ownership only of the input you supply, and expressly decline to warrant that an output is original, non-infringing, or even copyrightable. Outputs may also not be unique — the same or a similar model may be produced for another user. We therefore do not promise you exclusive rights in an output, and you should not resell an output as an exclusive asset. Our per-engine rights register is published at /3d/legal/output-rights/.
• You grant us a limited license to store, process, and display your inputs/outputs as needed to operate the Service (and, for content you publish to the public gallery, to display it publicly).
• We do not use paid users' inputs/outputs to train our models without consent. We may use aggregated, de-identified data to improve the Service.

6. Acceptable use

Your use is subject to the Acceptable Use Policy. Violations may result in removal, suspension, or termination, and where required, reporting to authorities.

7. Intellectual property & third parties

The Service, excluding your inputs/outputs, is owned by Hibr AI. Third-party model providers' terms may also apply to certain generations. You may not use outputs to train competing models or to infringe third-party rights.

8. AI disclosure

Outputs are AI-generated and labeled as such. You agree not to misrepresent AI-generated outputs as human-made where prohibited by law.

9. Disclaimers & limitation of liability

THE SERVICE AND OUTPUTS ARE PROVIDED "AS IS," WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT TO THE MAXIMUM EXTENT PERMITTED BY LAW. We are not liable for indirect, incidental, or consequential damages, or for any use of outputs (including printing/manufacturing). Our aggregate liability is limited to the amount you paid in the preceding 3 months.

10. Indemnification

You will indemnify Hibr AI against claims arising from your inputs, outputs, or use of the Service in violation of these Terms or law.

11. Termination

We may suspend or terminate your access for violations. You may cancel anytime; certain terms survive termination.

12. Changes, governing law, disputes

We may update these Terms with notice. These Terms are governed by the law of the United Arab Emirates as applied in the Emirate of Sharjah. The competent courts of the Emirate of Sharjah have exclusive jurisdiction over any dispute not resolved by good-faith escalation, and each party irrevocably submits to that jurisdiction. This matches the forum in the HIBR Terms of Service — where the two documents differ, the HIBR Terms of Service governs.
